Approximately 39 states plus Washington DC have legalized sports betting in some form as of 2026; roughly 32 of those permit statewide online and mobile wagering. That means placing an over under bet legally from your phone is possible for the majority of US adults — but not all.

The Supreme Court struck down PASPA on May 14, 2018, in Murphy v. NCAA, handing each state the authority to legalize sports betting on its own terms. Most large-population states moved quickly. A few still haven't moved at all.

Florida is a special case: mobile betting is restricted to Hard Rock Bet under the Seminole tribal compact, upheld in 2025. Mississippi permits app-based wagering only on-site at licensed casinos — fully mobile play statewide is not available. Montana limits sports betting to state-authorized lottery terminals and an approved app in designated locations only. Some tribes in New Mexico, North Dakota, Washington, and Wisconsin offer sports betting under existing Class III gaming compacts without separate state legislation.

Where Is Over Under Betting Still Illegal?

Several high-population states remain off the board. California is the biggest: Prop 26 and Prop 27 both failed in November 2022, leaving online sports betting illegal statewide. Texas, the second-most-populous state, has no legal sports betting of any kind. Other states with no legal framework as of 2025–2026: Utah, Idaho, Hawaii, Alaska, Alabama, Georgia, Minnesota, South Carolina, and Oklahoma.

How Taxes Apply Once You're in a Legal State

Winning a totals bet in a legal state doesn't end your obligations. All gambling winnings are federally taxable income. A W-2G is issued when net winnings exceed $600 and are at least 300 times the wager. Starting tax year 2026, the new across-the-board W-2G reporting threshold rises to $2,000 under the 2025 federal tax bill.
