Which states still have no legal sports betting in 2026?
As of 2025–2026, the following states have no legal sports betting of any kind: Texas, Utah, Idaho, Hawaii, Alaska, Alabama, Georgia, Minnesota, South Carolina, and Oklahoma. Residents in these states cannot legally wager on totals — or any other bet type — through a licensed domestic sportsbook.

What happened with California sports betting?
California is the largest state by population and still has zero legal online sports betting. Voters rejected both Prop 26 (retail sportsbooks at tribal casinos and horse-racing tracks) and Prop 27 (statewide online betting backed by commercial operators) in November 2022. No replacement ballot measure has passed. Californians have no legal online totals market available through a licensed operator.
Is Florida a legal state for over under bets?
Florida is a partial answer. Mobile sports betting is available only through Hard Rock Bet under the Seminole Tribe's gaming compact, which was upheld in 2025. No competing operators are licensed for mobile wagering in the state. Bettors who want access to multiple sportsbooks and competitive totals lines cannot get that in Florida.
How does this compare to states that recently launched?
The contrast with recently launched states is stark. Missouri went live with online sportsbooks in December 2025 under Amendment 2. Vermont launched January 11, 2024 with three operators. Are there any legal options for residents of banned states?
No licensed US sportsbook is permitted to accept wagers from residents of states without legal sports betting. Some bettors in illegal states travel to a neighboring legal state to place bets in person or via a geo-compliant mobile app — that is legal where the activity takes place, not where the bettor lives. Offshore and unlicensed sportsbooks operate outside US law; using them carries financial and legal risk that licensed books do not present. What about taxes if you bet while traveling in a legal state?
Winnings are still taxable federal income regardless of your home state. A W-2G is issued when net winnings exceed $600 and are at least 300 times the wager.
